My Speeding Ticket Update

So, back in April I got a speeding ticket, here’s the story: Are Police Above The Law?
One of my reps had one of her people forward it to the PSP as I requested (the day after I sent it to them) and I got a response from PSP today (finally). Here it is:

Mr. ROOTE,
Your complaint regarding Tpr. EILER’s driving and duty performance on 04/27/12 has been reviewed by myself and several members of the PSP command staff.

After a thorough review, we have found no wrongdoing on the part of Tpr. EILER, and no violations of departmental regulations.

Your complaint has been resolved and the matter closed.

It is apparent that you, and Eiler, believe that you are above the law.
This means that you do not actually recognize the rule of law unless it

Reestablish the Rule of Law before it is too late. Punish Eiler for his
violations (that were recorded on video) and spread the word amongst your
troops that further violations of the law will not be tolerated before the
citizens feel they have to correct you. The fact that I was speeding is
not in dispute, but in the video you can clearly see that I was following
Eiler at the same speed he was travelling without lights and/or sirens (as
required by state law). That is all the evidence you need to prove that
he was violating the law. His attitude when I questioned him about his
speed is more than enough to show that he doesn’t believe the law applies
to him. I won’t go into his actions when I asked him about it in the
courtroom, but it was even more disturbing than what you can see in the
video.

So, back in April I attended the Liberty Summit in Mercer, PA. Those that were there knew that I got a speeding ticket while en-route. The thing is, I did it on purpose. Well, before I write the whole story twice, here’s the email I just sent:

I cannot find any email addresses for the State Police or its Commissioner (Frank Noonan), so please forward this message in its entirety to him so that he/they can view the linked video.

Back on April 27th I was traveling across the state on I-80 West. It was still early in the day and there hadn’t been much traffic all morning, individual vehicles here and there, but absolutely no congestion… until I got to the Williamsport area. I got to that area and there was a long line of vehicles in both lanes that couldn’t maintain a speed to save their life. For the record, I am a disabled vet with two bad knees, when I travel any distance I set my cruise control within 5 mph of the speed limit, when I have to take the cruise off for no apparent reason it not only annoys me, but it starts to hurt after a while.
Anyway, after about 15 minutes, I finally managed to weave my way far enough through this traffic to see that the cause for this congestion was a State Police Cruiser. He was fluctuating his speed between 65-80 mph and changing lanes frequently, whether there was any reason to or not. After another few minutes of this nonsense, I decided to pull out my video camera and record what I was about to do. I had decided to get up behind this cruiser, set my cruise control, and then pass whenever he moved over. So that’s what I did, and I got pulled over and was issued a speeding ticket. Now, I won’t deny that the speed he (and I) were moving at when I set my cruise control was well above the posted speed limit, but when he said he pulled me over for speeding, I asked him “what about your speeding?” He acted like he wasn’t speeding and seemed offended that I would even think that he could have been breaking the law.
So, I plead not guilty and took it to court. I know that I was, in fact, guilty of speeding, but the whole purpose for me getting the speeding ticket in the first place was to prove that he was breaking the law (I haven’t had a speeding ticket other than this one in around 10 years, I don’t drive like that anymore). So, we get to court and Eiler tried to make me an offer to plead out because he “didn’t appreciate the way it went”. He said that I could plead out to a simple failure to obey a signal and there would be no points on my license. I decided to go ahead and take the trial.
So, we get into the trial and he proceeds to state his case against me. When it was my turn, I decided that rather than to defend myself I would accuse him. All I want is EQUAL JUSTICE. He is not above the law… or is he? Eiler seems to believe that he is above the law. At one point, he actually stated that he has the right to speed. First off, my rights come from my Creator, not from any government. Secondly, while he may have the authority to speed, PA Title 75 (The Pennsylvania Vehicle Code) §3105(a) says that The driver of an emergency vehicle, when responding to an emergency call or when in the pursuit of an actual or suspected violator of the law or when responding to but not upon returning from a fire alarm or other emergency call, may exercise the privileges set forth in this section, but subject to the conditions stated in this section. So, prior to my passing Eiler, none of these conditions were met, but he was speeding in violation of the law. Let’s continue. PA Title 75 §3105(b)(3) states that the driver may exceed the maximum speed limits so long as the driver does not endanger life or property… Well, we already know that none of the conditions required to allow him to exceed the speed limit were met prior to my passing him, so let’s look a little closer: he was endangering life and property by causing congestion on a highway where there was no reason for it (prior to and after my interactions with Eiler, for the entire 300 mile trip I was on, there was absolutely no congestion on the interstate)… well, there’s another violation of state law. But wait, I’m not done yet. 75§3105(c) says The privileges granted in this section to an emergency vehicle shall apply only when the vehicle is making use of an audible signal and visual signals meeting the requirements and standards set forth in regulations adopted by the department. Well, you can see in the attached video that he was not using either audible or visual signals while cruising down the interstate at 80 mph.
So, since I am not allowed to pull someone over or to write tickets, I passed him to make him stop. He seemed indignant at the time that I would question him about his speed. When in the courtroom, I asked him what his maximum speed was before he ever saw me and he couldn’t answer. Then I asked him what his average speed was and he couldn’t answer. He stated that he doesn’t pay attention to his speedometer while driving, but he “doesn’t have a lead foot, so it’s not an issue”. Umm… Eiler… I have video that would disagree with that statement.
Also, at the very end of the video, you can see Eiler pull away and make an immediate u-turn. When we were in the courtroom, he claims that he left “in such a hurry” because he was responding to a domestic disturbance call. Umm, OK, so he was actually (supposedly) responding to an emergency call but didn’t turn on lights or siren? Yet another violation of state law. How many violations of the law is he allowed in an hour?

I’d put my weapons skills against his. I also wonder what his education level is? The point of listing some of my skills and qualifications is that Eiler is most certainly no better than me in any aspect that I can imagine (I’m pretty sure I have a firmer grasp of the Constitution than he does too).

Yet, this fat cop thinks he is above the law?

He is not the first officer that I have come across that believes he is above the law. I am tired of this holier than thou attitude from public servants. I am a citizen of the Commonwealth of Pennsylvania and of these United States of America. I am not a servant nor a subject. I am writing you people to get you to take action to ensure that there is equal justice for everyone, regardless of their profession. This is a nation of laws. When the Rule of Law no longer applies to a select portion of the population, it no longer applies to any portion. Do you really want to see what happens when the rule of law is dead?

Also, I have not contacted any media about this yet, but if I don’t hear about some momentum soon to correct this (and other) officers attitude, I will begin contacting media until something is done to eliminate the elitist attitude.

(National Weather Service) If you have a cell phone, it may soon make some curious sounds and vibrations the next time you find yourself in the possible path of a tornado or several other types of weather emergencies.

Starting any day now, the Wireless Emergency Alerts (WEA) system will go live. That means National Weather Service warnings for dangerous weather, including tornadoes, flash flooding and hurricanes, will be delivered free of charge to many mobile users on major wireless carriers. The alerts will look like text alerts, but use a different technology that is not affected by network congestion.

The WEA system is “location-based,” which means that you only receive alerts relevant to your physical location. In other words, if you travel to another city, you’ll receive alerts for where you are, not back home.

AMBER Alerts and Presidential Alerts during a national emergency will also be delivered through the WEA system. If you have a WEA-capable phone, you’ll receive alerts unless you opt out (you can’t opt out of Presidential Alerts, however).

Interestingly, the alerts will *not* interrupt phone conversations, but rather will be delayed until a call is finished.

OK, so, now you’ve read that. It sounds good, doesn’t it? Now you don’t have to look for a special app to track the weather and weather warnings around you, right?
But wait, hold on a second, let me re-read this, something just doesn’t feel right about it. What was that piece that caught my attention?
Hmmm… oh, yeah, there it is, “AMBER Alerts and Presidential Alerts during a national emergency will also be delivered through the WEA system. If you have a WEA-capable phone, you’ll receive alerts unless you opt out (you can’t opt out of Presidential Alerts, however).”

So, while this system will appeal to the lazy masses, it doesn’t occur to them that the federal government will now be empowered to “provide” you with any information they want, based on your location. This means that the governments own computers will undoubtedly be tracking your every movement with your cell phone. I know, you say they already do that, and I won’t disagree, the only difference as I see it is that right now the government has to “request” that data from a third party (just because the third parties never deny them doesn’t mean they aren’t required to “ask”). Since this WEA program is a location based service to provide you with real-time alerts, this means the computers must know where you are. Does anyone believe that the government will “forget” to disable the memory on those computers?

I also see a lot of other reasons why this is a bad thing, but I don’t know where to begin pointing them out.

OK, so that’s where I’m at, this is one more violation against us, but what do we do about it? I’m open to suggestions here. Short of lead flying, I’m not sure what we can do.

Trouble Sleeping Ahead

A very disturbing thought just occurred to me.
Remember a couple of months ago when the DOJ decided to make it legal for them to lie to anyone and say that “no documents exist” in response to any FOIA requests they might receive?
OK, now there’s this new NDAA that does not specifically prohibit the indefinite detention of American Citizens captured on American soil just because the government says so. (No link, it is recent enough that damn near every blog and even some “mainstream” “news” networks are talking about it).

So, the thought that occurred to me was:
Fedgov decides I’m a threat. They break into my house and manage to capture me without killing me or my family. They ship me to Gitmo. My wife contacts an attorney who then contacts the agency that my wife says entered my house (they all have big white letters, right?). Said agency denies entering my house and denies the existence of any documents about me or any investigation they may have had ongoing about me.

Declaration of War

I just sent this to Tom Marino’s (PA 10th) legislative director:

Justify to me how Tom voted yes on the bill that allows capture and indefinite detention of American citizens captured on American soil without the benefit of any trial.
I am not asking for this, I am demanding it… Agreeing to this bill is a Declaration of War on the People of the United States.
You can try to claim that there are provisions that protect citizens, but before you tell me that; define a terrorist and explain to me how any TEA Party member, extreme couponer or Mormon couldn’t fit into the loose definition of ‘terrorist’ in this bill.

There is a very slim chance that you can convince me that this act cannot be abused now by the obama administration or in the future by any other administration.

I understand that it was included in the DOD appropriations bill, but it would have been better to vote no and defund the military than to allow this evil through. And this is coming from someone that has a LOT of friends currently serving overseas in combat zones. I do not make this statement lightly. It would be better to bring them and all of our equipment home than to pass this bill. So, claiming that he “had” to pass the bill to “take care of our troops” is a bullshit answer. That is NO reason to declare war on the People of this country.

I cannot stress this enough. The House and the Senate have declared war on We The People and the president is expected to sign it tomorrow. He has already said that he would not veto it. Do you fucking idiots have any god damned idea what you are fucking with. I personally fit into several of the “suspected terrorist” categories. When the government decides to come and get me, PEOPLE WILL DIE. Yes, I will most likely be one of them, but I will not be the only one. You fucking idiots are playing with a flamethrower in a fucking magazine and expecting life to go on. Do you have any idea what Tom and the other 283 congressmen have just done?

There is a saying in my line of work. I work in Industrial Safety, specifically in mitigating the chances of a dust explosion. Basically there are 4 things you need for an explosion to occur: 1) Enclosure 2) Fuel 3) Oxygen and 4) Spark. The saying is that ignition is free. More ‘Only Ones’ Protection

If my employer can record anything I do on their property and on their dime, why the hell do the police think they are special (don’t answer that, they’re all arrogant assholes). Well, the police are OUR employees, they need to be forced to answer to US for the crimes they commit.

The police (and ALL government employees) have absolutely NO reasonable expectation of privacy while on the clock. Since more and more police are showing themselves to be criminals, usually violent ones, I’ll be damned if I’m going to have any unrecorded interaction with them… whether I have their “permission” or not. I don’t trust them. It’s that simple.

Let’s face it, there was a time when people with a badge were respected and usually told the truth. It was easier to believe they were being honest because the people they arrested were usually criminals. Unfortunately that is no longer true. I am more inclined to believe the perp than I am to believe the badge these days. The bad part is, most juries will still believe the badge, which is why I intent to have a recording to back me up. I try not to lie, I want the proof of that.

On a similar note, what about making a button to wear on your hat or shirt that says “This conversation is being recorded for training purposes”? (Kinda like when you call most businesses)
I am making it habit to never leave the house without at least my digital audio recorder running. If nothing happens, I just delete the file, but if anything does happen I have the recording. We shouldn’t need it, but this could be our disclaimer to the police… ie, “This conversation is being recorded, if you don’t want to be recorded, walk away”. If I have time, or know in advance that I’m likely walking into trouble, I have my iPhone set up to do a live stream to YouTube (thanks to qik.com). I used this feature while in Philly in November 2010.

Before I proceed further:
I decided to call his office before completing this post so I could relay the conversation and the lady that answered the phone said that the case was dismissed. I have since sent the following email to the Circuit Clerk’s office:

The case was declared Unconstitutional on September 15, 2011. They State’s
Attorney and Attorney General’s Office has appealed it to the Supreme Court.

So, it would seem that the Judge had some sense, but the State’s Attorney (Wiseman) and the Attorney General need a wake up call.

I just called Senator Toomey’s office in DC and pretty much got the response I expected. The phone call went pretty much as follows:
Toomey’s Assistant (TA): “Senator Toomey’s office”
Me: “I need some information on the Defense Bill that just passed”
TA: “What information do you need?”
Me: “If I read this thing correctly, an amendment was included that allows the military to arrest and detain an American citizen on American soil indefinitely without any form of trial… Is this true?”
TA: “Please hold”
Me: *twiddles my thumbs*
TA: “There were 2 amendments that talked about this (he gave me numbers, but I didn’t write them down), and American citizens are specifically exempted”
Me: “Yeah, I read that, but that’s not what it said, it said American citizens were exempted UNLESS they were affiliated with Al Qaeda or a similar organization.”
TA: “I’ll let the senator know that you’re disappointed with his vote on…” (I cut him off)

I won’t waste my time calling Casey’s office as I already know that he is a progressive jackass and not worth my time. He will not be returning to office after 2012 (if we make it that far), so we just have to put up with him for now.

I’ve had a few thoughts running around in my head lately, and reading some of AP’s and CA’s recent posts has only been pushing the point home for me. Some of the specific posts are: The Fan Is Already Covered In It, Mommy, Make The Bad Man Stop, Quit Learning What You Already Know, Robbery And Opportunity, Support Your Local Police (State), Res Ipsa Loquitur, Vanderboegh: More On The Crisis Of Legitimacy, Civil War, And Resistance. There are many more from these two and others (many of whom are linked within the links in this post), but I’d like to actually say something before you get too tired of reading everyone elses posts.
The main recurring thought for me has been, when is it time? This is the hardest thing to admit to, but the time is now… actually, the time was about 30 or 40 years ago (or more) but it is what it is, and it is time. I say again, this is the hardest thing for me to admit/accept. I am a good person with a pretty solid set of morals, and I believe that all of us that want to be free are together in that. The reason it’s so hard for me to accept that the time is now is that “they” haven’t actually done anything to “me”. I mean sure, they tax the crap out of me. They make me follow insane rules. But they haven’t actually done anything to me. I’m still “free” (I’m not in jail, right?) I’m alive and I have a good job. I can pack up the family and drive somewhere for vacation… I can’t fly because I refuse to travel unarmed and I can’t take any weapons on the plane with me… and the driving thing has to be done carefully so they have no reason to inspect my car and find the personal protection available to me, but I can still do it. I’m still free, right?
As I said, I’m a good person with strong morals and breaking the law is wrong… right?
Well, every day that goes by we hear another news story about a different cop or politician breaking the law with impunity. “Well,” you say, “they’ll get justice.” But then they don’t, and they do it again and again and again. Every time they get away with it, they move up in the world of crime. But if they’re not getting in trouble and everyone knows, are they really breaking the law?
Justice has not been served to the “elite” for way too long. The time is NOW to start serving justice again, and if the cops and robbers politicians won’t do it, then we must. Now, we all know that to serve justice is currently against the law, so I won’t even begin to suggest what justice needs to be served, only that they it needs to happen, desperately. Obviously, begging “them” to make things right isn’t working. I’ve been to rallies, I’ve contacted my reps, but it’s not working. Every once in a while someone appears to be listening, and then they do something that proves they aren’t. Until the “elite” fear the People, nothing will get better.

Yep. All Catholics are 100% exempt from ObamaCare. It’s on page 107, y’all. Those of you who have been around here for a long time remember that I actually first went viral in March of 2010. I’ll bet most of you newbies received an email with a very brief blurb I wrote about ObamaCare. My name was quickly edited out of it (no problem at all), but I am indeed the original author of this piece:

Dhimmitude is the muslim system of controlling non-muslim populations conquered through jihad. Specifically, it is the TAXING of non-muslims in exchange for tolerating their presence AND as a coercive means of converting conquered remnants to islam.

The ObamaCare bill is the establishment of Dhimmitude and Sharia muslim diktat in the United States. Muslims are specifically exempted from the government mandate to purchase insurance, and also from the penalty tax for being uninsured. Islam considers insurance to be “gambling”, “risk-taking” and “usury” and is thus banned. Muslims are specifically granted exemption based on this. How convenient. So I, Ann Barnhardt, a Christian, will have crippling IRS liens placed against all of my assets, including real estate, cattle, and even accounts receivables, and will face hard prison time because I refuse to buy insurance or pay the penalty tax. Meanwhile, Louis Farrakhan will have no such penalty and will have 100% of his health needs paid for by the de facto government insurance. Non-muslims will be paying a tax to subsidize muslims. Period. This is Dhimmitude.

Dhimmitude serves two purposes: it enriches the muslim masters AND serves to drive conversions to islam. In this case, the incentive to convert to islam will be taken up by those in the inner-cities as well as the godless Generation X, Y and Z types who have no moral anchor. If you don’t believe in Christ to begin with, it is no problem whatsoever to sell Him for 30 pieces of silver. “Sure, I’ll be a muslim if it means free health insurance and no taxes. Where do I sign, bro?”

If you are a Christian and you acquiesce to this, you will be bending your knee to islam, and denying Christ. How many of the early Christians went to horrific deaths rather than offer a mere pinch of incense to a statue of Caesar? Every single one of us has a BIG decision to make right now, in this moment. The choice is to either offer a pinch of incense to islam and Marxism, or take up our cross and follow Christ. I’ve made my decision. I choose Christ. I choose the Cross.

If I had it to do over again, I would remove the word “specifically” from the fourth sentence. The word “specifically” implies that the word “islam” appears in the ObamaCare bill. It does not. The exemption was inserted to give musloids an exemption from ObamaCare, but was sufficiently vague so as to not specify islam as the beneficiary of the language. We’ll come back to that in a moment. (5) EXEMPTIONS FROM INDIVIDUAL RESPONSIBILITY REQUIREMENTS.—In the case of an individual who is seeking an exemption certificate under section 1311(d)(4)(H) from any requirement or penalty imposed by section 5000A, the following information:

In the case of an individual seeking exemption based on the individual’s status as a member of an exempt religious sect or division, as a member of a health care sharing ministry, as an Indian, or as an individual eligible for a hardship exemption, such information as the Secretary shall prescribe.

The premise of my original piece was that musloids would demand, en masse, an exemption from the ObamaCare mandate arguing that insurance was “forbidden” and thus fall onto the government healthcare rolls, effectively creating a situation wherein “infidels” were fully subsidizing their healthcare. My point is, contraception and abortion are mortal sins. They jeopardize a person’s immortal soul. ObamaCare is DEMANDING that every American Catholic and Christian of good will who believes in the Truth literally put themselves in a position wherein they are in grave sin and are rejecting and betraying Christ, and are thus in danger of eternal damnation, according to the teachings of Christ and His Church. Ladies and gentlemen, this is a DIRECT VIOLATION OF THE FIRST AMENDMENT. ObamaCare makes it FUNCTIONALLY IMPOSSIBLE to be a Roman Catholic AND an American. It prohibits the FREE EXERCISE of Catholicism. Period. This is not debatable. It is an objective fact.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Good grief, muslims can literally get away with murder in the name of “honor killing”. You’re telling me this can’t even be ARGUED???? Of course it can. Someone just needs to man up and do it.

The verbiage in the ObamaCare act was inserted to give musloids an “out”. But God, in His very clever Grace, has sown the seeds of ObamaCare’s destruction in the very words that were designed to make non-muslims de facto second class citizens. I am now reminded of Alinsky Rule #4: Make the Enemy live up to its own book of rules.

I can’t tell you how delicious and beautiful this is. You want to end ObamaCare, America? Well, well. It just so happens that they way to do that is to RETURN TO CHRIST and reject the evil of contraception and abortion once and for all. If you reject contraception you can bring ObamaCare crashing down. If you choose to continue sowing the wind, you will be made to reap the whirlwind. God is One Smart Dude. If you won’t do it willingly, he’ll just FORCE you to do it, using the sword of the enemy hanging over your head to make you understand. Talk about sifting the wheat from the chaff! Yeah. He’s getting totally Old Testament with us now. Either you choose Him and the Truth, or you’re going to get your butt kicked. Does this make you uncomfortable? Does this piss you off? Wow. I so totally DON’T CARE. This must be how Jeremiah felt. Well, bring the cistern, baby. Let’s do this.
